  67. compilation and installation of an Executable, or source code\par
  68. differential comparisons against either the Original Code or another\par
  69. well known, available Covered Code of the Contributor's choice. The\par
  70. Source Code can be in a compressed or archival form, provided the\par

  83. entity.\par
  84. \par
  85. 2. Source Code License.\par
  86. \par
  87. 2.1. The Initial Developer Grant.\par
  88. The Initial Developer hereby grants You a world-wide, royalty-free,\par
  89. non-exclusive license, subject to third party intellectual property\par
  90. claims:\par
  91. (a) under intellectual property rights (other than patent or\par
  92. trademark) Licensable by Initial Developer to use, reproduce,\par
  93. modify, display, perform, sublicense and distribute the Original\par
  94. Code (or portions thereof) with or without Modifications, and/or\par
  95. as part of a Larger Work; and\par
  96. \par
  97. (b) under Patents Claims infringed by the making, using or\par
  98. selling of Original Code, to make, have made, use, practice,\par
  99. sell, and offer for sale, and/or otherwise dispose of the\par
  100. Original Code (or portions thereof).\par
  101. \par
  102. (c) the licenses granted in this Section 2.1(a) and (b) are\par
  103. effective on the date Initial Developer first distributes\par
  104. Original Code under the terms of this License.\par
  105. \par
  106. (d) Notwithstanding Section 2.1(b) above, no patent license is\par
  107. granted: 1) for code that You delete from the Original Code; 2)\par
  108. separate from the Original Code; or 3) for infringements caused\par
  109. by: i) the modification of the Original Code or ii) the\par
  110. combination of the Original Code with other software or devices.\par
  111. \par
  112. 2.2. Contributor Grant.\par
  113. Subject to third party intellectual property claims, each Contributor\par
  114. hereby grants You a world-wide, royalty-free, non-exclusive license\par
  115. \par
  116. (a) under intellectual property rights (other than patent or\par
  117. trademark) Licensable by Contributor, to use, reproduce, modify,\par
  118. display, perform, sublicense and distribute the Modifications\par
  119. created by such Contributor (or portions thereof) either on an\par
  120. unmodified basis, with other Modifications, as Covered Code\par
  121. and/or as part of a Larger Work; and\par
  122. \par
  123. (b) under Patent Claims infringed by the making, using, or\par
  124. selling of Modifications made by that Contributor either alone\par
  125. and/or in combination with its Contributor Version (or portions\par
  126. of such combination), to make, use, sell, offer for sale, have\par
  127. made, and/or otherwise dispose of: 1) Modifications made by that\par
  128. Contributor (or portions thereof); and 2) the combination of\par
  129. Modifications made by that Contributor with its Contributor\par
  130. Version (or portions of such combination).\par
  131. \par
  132. (c) the licenses granted in Sections 2.2(a) and 2.2(b) are\par
  133. effective on the date Contributor first makes Commercial Use of\par
  134. the Covered Code.\par
  135. \par
  136. (d) Notwithstanding Section 2.2(b) above, no patent license is\par
  137. granted: 1) for any code that Contributor has deleted from the\par
  138. Contributor Version; 2) separate from the Contributor Version;\par
  139. 3) for infringements caused by: i) third party modifications of\par
  140. Contributor Version or ii) the combination of Modifications made\par
  141. by that Contributor with other software (except as part of the\par
  142. Contributor Version) or other devices; or 4) under Patent Claims\par
  143. infringed by Covered Code in the absence of Modifications made by\par
  144. that Contributor.\par
  145. \par
  146. 3. Distribution Obligations.\par
  147. \par
  148. 3.1. Application of License.\par
  149. The Modifications which You create or to which You contribute are\par
  150. governed by the terms of this License, including without limitation\par
  151. Section 2.2. The Source Code version of Covered Code may be\par
  152. distributed only under the terms of this License or a future version\par
  153. of this License released under Section 6.1, and You must include a\par
  154. copy of this License with every copy of the Source Code You\par
  155. distribute. You may not offer or impose any terms on any Source Code\par
  156. version that alters or restricts the applicable version of this\par
  157. License or the recipients' rights hereunder. However, You may include\par
  158. an additional document offering the additional rights described in\par
  159. Section 3.5.\par
  160. \par
  161. 3.2. Availability of Source Code.\par
  162. Any Modification which You create or to which You contribute must be\par
  163. made available in Source Code form under the terms of this License\par
  164. either on the same media as an Executable version or via an accepted\par
  165. Electronic Distribution Mechanism to anyone to whom you made an\par
  166. Executable version available; and if made available via Electronic\par
  167. Distribution Mechanism, must remain available for at least twelve (12)\par
  168. months after the date it initially became available, or at least six\par
  169. (6) months after a subsequent version of that particular Modification\par
  170. has been made available to such recipients. You are responsible for\par
  171. ensuring that the Source Code version remains available even if the\par
  172. Electronic Distribution Mechanism is maintained by a third party.\par
  173. \par
  174. 3.3. Description of Modifications.\par
  175. You must cause all Covered Code to which You contribute to contain a\par
  176. file documenting the changes You made to create that Covered Code and\par
  177. the date of any change. You must include a prominent statement that\par
  178. the Modification is derived, directly or indirectly, from Original\par
  179. Code provided by the Initial Developer and including the name of the\par
  180. Initial Developer in (a) the Source Code, and (b) in any notice in an\par
  181. Executable version or related documentation in which You describe the\par
  182. origin or ownership of the Covered Code.\par
  183. \par
  184. 3.4. Intellectual Property Matters\par
  185. (a) Third Party Claims.\par
  186. If Contributor has knowledge that a license under a third party's\par
  187. intellectual property rights is required to exercise the rights\par
  188. granted by such Contributor under Sections 2.1 or 2.2,\par
  189. Contributor must include a text file with the Source Code\par
  190. distribution titled "LEGAL" which describes the claim and the\par
  191. party making the claim in sufficient detail that a recipient will\par
  192. know whom to contact. If Contributor obtains such knowledge after\par
  193. the Modification is made available as described in Section 3.2,\par
  194. Contributor shall promptly modify the LEGAL file in all copies\par
  195. Contributor makes available thereafter and shall take other steps\par
  196. (such as notifying appropriate mailing lists or newsgroups)\par
  197. reasonably calculated to inform those who received the Covered\par
  198. Code that new knowledge has been obtained.\par
  199. \par
  200. (b) Contributor APIs.\par
  201. If Contributor's Modifications include an application programming\par
  202. interface and Contributor has knowledge of patent licenses which\par
  203. are reasonably necessary to implement that API, Contributor must\par
  204. also include this information in the LEGAL file.\par
  205. \par
  206. (c) Representations.\par
  207. Contributor represents that, except as disclosed pursuant to\par
  208. Section 3.4(a) above, Contributor believes that Contributor's\par
  209. Modifications are Contributor's original creation(s) and/or\par
  210. Contributor has sufficient rights to grant the rights conveyed by\par
  211. this License.\par
  212. \par
  213. 3.5. Required Notices.\par
  214. You must duplicate the notice in Exhibit A in each file of the Source\par
  215. Code. If it is not possible to put such notice in a particular Source\par
  216. Code file due to its structure, then You must include such notice in a\par
  217. location (such as a relevant directory) where a user would be likely\par
  218. to look for such a notice. If You created one or more Modification(s)\par
  219. You may add your name as a Contributor to the notice described in\par
  220. Exhibit A. You must also duplicate this License in any documentation\par
  221. for the Source Code where You describe recipients' rights or ownership\par
  222. rights relating to Covered Code. You may choose to offer, and to\par
  223. charge a fee for, warranty, support, indemnity or liability\par
  224. obligations to one or more recipients of Covered Code. However, You\par
  225. may do so only on Your own behalf, and not on behalf of the Initial\par
  226. Developer or any Contributor. You must make it absolutely clear than\par
  227. any such warranty, support, indemnity or liability obligation is\par
  228. offered by You alone, and You hereby agree to indemnify the Initial\par
  229. Developer and every Contributor for any liability incurred by the\par
  230. Initial Developer or such Contributor as a result of warranty,\par
  231. support, indemnity or liability terms You offer.\par
  232. \par
  233. 3.6. Distribution of Executable Versions.\par
  234. You may distribute Covered Code in Executable form only if the\par
  235. requirements of Section 3.1-3.5 have been met for that Covered Code,\par
  236. and if You include a notice stating that the Source Code version of\par
  237. the Covered Code is available under the terms of this License,\par
  238. including a description of how and where You have fulfilled the\par
  239. obligations of Section 3.2. The notice must be conspicuously included\par
  240. in any notice in an Executable version, related documentation or\par
  241. collateral in which You describe recipients' rights relating to the\par
  242. Covered Code. You may distribute the Executable version of Covered\par
  243. Code or ownership rights under a license of Your choice, which may\par
  244. contain terms different from this License, provided that You are in\par
  245. compliance with the terms of this License and that the license for the\par
  246. Executable version does not attempt to limit or alter the recipient's\par
  247. rights in the Source Code version from the rights set forth in this\par
  248. License. If You distribute the Executable version under a different\par
  249. license You must make it absolutely clear that any terms which differ\par
  250. from this License are offered by You alone, not by the Initial\par
  251. Developer or any Contributor. You hereby agree to indemnify the\par
  252. Initial Developer and every Contributor for any liability incurred by\par
  253. the Initial Developer or such Contributor as a result of any such\par
  254. terms You offer.\par
  255. \par
  256. 3.7. Larger Works.\par
  257. You may create a Larger Work by combining Covered Code with other code\par
  258. not governed by the terms of this License and distribute the Larger\par
  259. Work as a single product. In such a case, You must make sure the\par
  260. requirements of this License are fulfilled for the Covered Code.\par
  261. \par
  262. 4. Inability to Comply Due to Statute or Regulation.\par
  263. \par
  264. If it is impossible for You to comply with any of the terms of this\par
  265. License with respect to some or all of the Covered Code due to\par
  266. statute, judicial order, or regulation then You must: (a) comply with\par
  267. the terms of this License to the maximum extent possible; and (b)\par
  268. describe the limitations and the code they affect. Such description\par
  269. must be included in the LEGAL file described in Section 3.4 and must\par
  270. be included with all distributions of the Source Code. Except to the\par
  271. extent prohibited by statute or regulation, such description must be\par
  272. sufficiently detailed for a recipient of ordinary skill to be able to\par
  273. understand it.\par
  274. \par
  275. 5. Application of this License.\par
  276. \par
  277. This License applies to code to which the Initial Developer has\par
  278. attached the notice in Exhibit A and to related Covered Code.\par
  279. \par
  280. 6. Versions of the License.\par
  281. \par
  282. 6.1. New Versions.\par
  283. Netscape Communications Corporation ("Netscape") may publish revised\par
  284. and/or new versions of the License from time to time. Each version\par
  285. will be given a distinguishing version number.\par
  286. \par
  287. 6.2. Effect of New Versions.\par
  288. Once Covered Code has been published under a particular version of the\par
  289. License, You may always continue to use it under the terms of that\par
  290. version. You may also choose to use such Covered Code under the terms\par
  291. of any subsequent version of the License published by Netscape. No one\par
  292. other than Netscape has the right to modify the terms applicable to\par
  293. Covered Code created under this License.\par
  294. \par
  295. 6.3. Derivative Works.\par
  296. If You create or use a modified version of this License (which you may\par
  297. only do in order to apply it to code which is not already Covered Code\par
  298. governed by this License), You must (a) rename Your license so that\par
  299. the phrases "Mozilla", "MOZILLAPL", "MOZPL", "Netscape",\par
  300. "MPL", "NPL" or any confusingly similar phrase do not appear in your\par
  301. license (except to note that your license differs from this License)\par
  302. and (b) otherwise make it clear that Your version of the license\par
  303. contains terms which differ from the Mozilla Public License and\par
  304. Netscape Public License. (Filling in the name of the Initial\par
  305. Developer, Original Code or Contributor in the notice described in\par
  306. Exhibit A shall not of themselves be deemed to be modifications of\par
  307. this License.)\par
  308. \par
  309. 7. DISCLAIMER OF WARRANTY.\par
  310. \par
  311. COVERED CODE IS PROVIDED UNDER THIS LICENSE ON AN "AS IS" BASIS,\par
  312. WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING,\par
  313. WITHOUT LIMITATION, WARRANTIES THAT THE COVERED CODE IS FREE OF\par
  314. DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE OR NON-INFRINGING.\par
  315. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE COVERED CODE\par
  316. IS WITH YOU. SHOULD ANY COVERED CODE PROVE DEFECTIVE IN ANY RESPECT,\par
  317. YOU (NOT THE INITIAL DEVELOPER OR ANY OTHER CONTRIBUTOR) ASSUME THE\par
  318. COST OF ANY NECESSARY SERVICING, REPAIR OR CORRECTION. THIS DISCLAIMER\par
  319. OF WARRANTY CONSTITUTES AN ESSENTIAL PART OF THIS LICENSE. NO USE OF\par
  320. ANY COVERED CODE IS AUTHORIZED HEREUNDER EXCEPT UNDER THIS DISCLAIMER.\par
  321. \par
  322. 8. TERMINATION.\par
  323. \par
  324. 8.1. This License and the rights granted hereunder will terminate\par
  325. automatically if You fail to comply with terms herein and fail to cure\par
  326. such breach within 30 days of becoming aware of the breach. All\par
  327. sublicenses to the Covered Code which are properly granted shall\par
  328. survive any termination of this License. Provisions which, by their\par
  329. nature, must remain in effect beyond the termination of this License\par
  330. shall survive.\par
  331. \par
  332. 8.2. If You initiate litigation by asserting a patent infringement\par
  333. claim (excluding declatory judgment actions) against Initial Developer\par
  334. or a Contributor (the Initial Developer or Contributor against whom\par
  335. You file such action is referred to as "Participant") alleging that:\par

  337. (a) such Participant's Contributor Version directly or indirectly\par
  338. infringes any patent, then any and all rights granted by such\par
  339. Participant to You under Sections 2.1 and/or 2.2 of this License\par
  340. shall, upon 60 days notice from Participant terminate prospectively,\par
  341. unless if within 60 days after receipt of notice You either: (i)\par

  361. indirectly infringes any patent where such claim is resolved (such as\par
  362. by license or settlement) prior to the initiation of patent\par
  363. infringement litigation, then the reasonable value of the licenses\par
  364. granted by such Participant under Sections 2.1 or 2.2 shall be taken\par
  365. into account in determining the amount or value of any payment or\par
  366. license.\par

  386. PROHIBITS SUCH LIMITATION. SOME JURISDICTIONS DO NOT ALLOW THE\par
  387. EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO\par
  388. THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.\par
  389. \par
  390. 10. U.S. GOVERNMENT END USERS.\par
